In the 2013 legislative session, Delaware adoptedenvironmental lien legislation authorizing the DelawareDepartment of Natural Resources and EnvironmentalControl (“DNREC”) to impose environmental liens on realproperty to recover its cleanup costs. Left unresolved in2013, but addressed in the recently concluded legislativesession, is the broader topic of lender liability forenvironmental conditions at sites that have been impactedby hazardous or regulated substances.
