Overview

Jeffrey Moyer is senior vice president of the firm.

Jeff’s varied litigation practice has included trying cases in all of Delaware’s state and federal courts.  A “talented lawyer with great judgment and client service” (Chambers USA), he focuses his practice primarily on complex commercial and intellectual property litigation.

Jeff has represented some of the world’s leading technology companies in intellectual property and licensing disputes in the U.S. District Court for the District of Delaware and the Delaware Court of Chancery. He also has represented clients in some of the largest civil cases brought in the Delaware Superior Court.

Jeff regularly speaks on litigation practice and ethics, and he contributes to the firm’s publications concerning litigation practice in Delaware.

  • Represented global semiconductor manufacturer in action alleging infringement of a U.S. patent directed to a coding method for increasing speed and compression ratio for digital image storage
  • Represented U.S. based airline accused of infringing two U.S. patents directed to a method and system of facilitating wireless e-commerce transactions
  • Represented Delaware limited liability company in complex commercial dispute concerning potentially unlimited environmental liabilities arising out of mining and related businesses which had been transferred numerous times over the course of several decades
  • Represented one of the world’s largest defense contractors in commercial dispute arising out of asset purchase agreement transferring contractor’s business unit
  • Represented leading semiconductor chip manufacturer in dispute concerning alleged violations of confidentiality provisions and covenant not to sue in patent portfolio licensing agreement
  • Represented international law firm in dispute concerning drafting and enforcement of earn out provisions in asset purchase agreement
  • Representing multinational semiconductor manufacturer in toxic tort case relating to fabrication of integrated circuits

U.S. Supreme Court Adopts New Indefiniteness Standard

In a decision that will doubtless lead to more patent claims being challenged as indefinite, the U.S. Supreme Court in Nautilus v. Biosig Instruments, unanimously held that a claim is indefinite if it fails to inform one of ordinary skill in the art of the scope of the invention with reasonable certainty.
